Класифікація принципів державного контролю цивільної авіації

Abstract

Стаття присвячена дослідженню принципів державного контролю в галузі цивільної авіації. Проаналізовано принципи державного контролю в галузі авіації та запропоновано класифікувати їх на дві групи: загальні та спеціальні. Проаналізовано їх взаємозв’язок з державним контролем в галузі цивільної авіації. Abstract. The article is devoted to the study of the principles of state control in the field of civil aviation. The principles of state control in aviation are analyzed and it is proposed to classify them into two groups: general and special. Their relationship with state control in the field of civil aviation is analyzed. Formulation of the problem. At present, there is no single classification of the principles of state control in the legislation and the specialized legal literature. It is worth noting that It is the system of principles that underlies state control in the field of civil aviation. State control in the field of civil aviation is a component of the control function of the state, which ensures the activity of state-governmental bodies. All principles of state control in the field of aviation are classified by author into two groups: general and special. General principles include those that are characteristic of state control not only in aviation but also in other activities (the principle of systematicity, systematicity and timeliness, efficiency and promptness, legality, transparency, scientificity, guarantee of equality of rights of all participants before the law, systematic nature) . Among the special principles are those that are specific to aviation activity only (principles of compliance of activity of aviation subjects with the requirements and norms of international law, ensuring requirements of safety of aviation activity, increased responsibility).
