Аналіз особливості валютного регулювання у зв’язку з введенням нового валютного законодавства в Україні

Abstract

У статті розглянуто особливості валютного регулювання у зв’язку з провадженням в дію Закону України «Про валюту і валютні операції» та постанов Правління Національного банку України, які є основою для розвитку зовнішньоекономічної діяльності та застосування нових підходів і принципів на валютному ринку України, в тому числі транскордонного переміщення коштів. Ліквідується ряд обмежень валютного контролю, спрощується ведення бізнесу в Україні як для нерезидентів, так і для резидентів. Ряд операцій з іноземною валютою, включаючи транзакції на суму менше 150 тис. грн., звільняються від контролю. Дозволено використання форвардних контрактів та свопи для хеджування валютних ризиків. НБУ зберігає за собою право на власний розсуд тимчасово вводити заходи захисту з метою стабілізації фінансової ситуації в країні у разі кризи. Предметом дослідження є теоретичні та організаційно-практичні проблеми валютного регулювання в Україні на основі законодавства. Objective (research objective) is to consider trends and changes in currency regulation in Ukraine, the impact of new legislation on the country’s economy, involvement of foreign partners and the consequences for domestic entrepreneurship, as well as features of the transition period. Methods The main research method is a system-structural approach that involves addressing the issue of currency regulation in connection with the introduction of a new currency in Ukraine. And also research methods: logical, scientific abstraction, comparative analysis and synthesis, systematization and grouping. Results. Ukraine has made another changes to the currency regulation, changing the legislative base. With the help of the National Bank of Ukraine, eight main regulations and two additional documents were developed, which began to operate from 2019 on the basis of the Law of Ukraine "On Currency and Currency Transactions" adopted on 21.06.2018, and entered into force on 7 February 2019. As a result, currency legislation became more liberal, but left the National Bank of Ukraine with the power to impose certain temporary restrictions. For the most part, innovations in the field of monetary legislation are business-related, however, some provisions affect ordinary citizens. The primary purpose of the Act and the new Ordinances is to eliminate total control and rules. These changes should contribute to improving the investment climate and expanding foreign economic activity. With the introduction of the new system of monetary legislation, the National Bank of Ukraine conducts currency control only for doubtful, large and risky transactions. Together with experts from the International Monetary Fund, some transitional provisions have been developed which provide for a step-by-step removal of all currency restrictions in accordance with the pace of improvement of macroeconomic conditions in Ukraine, the adoption of laws aimed at improving the quality of regulation of the non-banking financial market and preventing unproductive capital outflow from the country. Scientific novelty investigates the impact of changes in currency laws on foreign exchange transactions, improving the investment climate, which contributes to the expansion of foreign economic relations. The main advantages of legislative changes, which operate on a continuous basis and time periods, which depend on the development of macroeconomic indicators of Ukraine, are identified. Practical significance is that the results of the research can be used in the field of introduction of foreign economic activity, in particular, attracting foreign investments, increasing the attractiveness of the investment climate in Ukraine and pursuing entrepreneurial activity in foreign markets.
