Парламентський контроль за додержанням прав і свобод людини і громадянина на вищу освіту у воєнний час: роль уповноваженого Верховної Ради України з прав людини

Abstract

Стаття присвячена дослідженню діяльності Уповноваженого Верховної Ради України з прав людини, як інституту державної влади, що має особливий статус у сфері здійснення парламентського контролю за додержанням конституційних прав і свобод людини і громадянина на вищу освіту у воєнний час та захисту цих прав у разі їх порушення. У статті вперше здійснено комплексний загально теоретичний аналіз конституційних прав і свобод людини і громадянина на вищу освіту та репрезентовано узагальнення результатів парламентського контролю з боку Уповноваженого Верховної Ради України з прав людини за додержанням цих конституційних прав у воєнний час. За результатами досліджуваної доведено, що право на вищу освіту за своєю природою належить до конституційного, оскільки забезпечене і гарантоване державою (статті 3, 22, 64, 102 Конституції України), має підвищений рівень захисту з боку держави (статті 24, 55 Конституції України), є невідчужуваним (стаття 21 Конституції України) та належить кожному (стаття 53 Конституції України). Водночас, на період дії правового режиму воєнного стану це право може обмежуватися. Уповноважений Верховної Ради України з прав людини є інститутом, який має винятковий конституційний статус у здійснені парламентського контролю за додержанням прав і свобод людини і громадянина на вищу освіту, оскільки даний вид контролю: здійснюється на постійній основі за різноманітними формами контролю – моніторинг, перевірка, опитування, експертний аналіз чинного законодавства та проєктів законів тощо; передбачає безперешкодне відвідування органів державної влади, органів місцевого самоврядування, підприємств, установи, організацій; відбувається за участю представників громадських організацій, експертів, вчених; передбачає можливість відкриття провадження за гнучкою і неформальною процедурою; може завершуватися таким актом реагування, як Конституційне подання Уповноваженого з метою вирішення питання про відповідність законодавству України у сфері вищої освіти КонституціїУкраїни. The article is devoted to the study of the activities of the Commissioner of the Verkhovna Rada of Ukraine for human rights, as an institution of the Commissioner of the Verkhovna Rada of Ukraine for human rights, as an institution of parliamentary control over the observance of constitutional rights and freedoms of man and citizen in Ukraine in the field of higher education during wartime and the protection of these rights in case of their violation. In the article, for the first time, a comprehensive general theoretical analysis of the constitutional rights and freedoms of a person and a citizen to obtain higher education was conducted and the results of parliamentary control by the Commissioner for Human Rights regarding the observance of these constitutional rights in wartime were summarized. According to the results of the study, it was proved that the right to higher education by its nature belongs to the constitutional right, since it is provided and guaranteed by the state (Articles 3, 22, 64, 102 of the Constitution of Ukraine), has a higher level of protection from the state (Articles 24, 55 of the Constitution of Ukraine), is inalienable (Article 21 of the Constitution of Ukraine) and belongs to everyone (Article 53 of the Constitution of Ukraine). At the same time, this right may be limited for the period of the legal regime of martial law. The Human Rights Commissioner of the Verkhovna Rada of Ukraine is an institution that has an exclusive constitutional status in the exercise of parliamentary control over the observance of human and citizen rights and freedoms in higher education, since this type of control: is carried out constantly in the form of monitoring, inspections, surveys, expert analysis of current legislation and draft laws, etc.; ensures unimpeded visits to state authorities, local governments, enterprises, institutions, and organizations; takes place with the participation of representatives of public organizations, experts, scientists; provides for the possibility of opening proceedings according to a flexible and informal procedure; may result in such a response act as a constitutional submission by the Commissioner for the purpose of resolving the issue of compliance of Ukrainian legislation in the field of higher education with the Constitution of Ukraine.
