Огляд особи та її речей як адміністративно-запобіжний захід в діяльності правоохоронних органів України

Abstract

Стаття присвячена розкриттю феномену огляду особи та її речей як адміністративно-запобіжного заходу в діяльності правоохоронних органів України та виділення основних його видів. В статі досліджується національне законодавство та праці науковців щодо підстав та порядку проведення огляду особи, особистих речей, ручної кладі, багажу посадовими особами митних органів, установ виконання покарань, органів охорони державного кордону, Національної поліції, служб авіаційної безпеки. Запропоновано власну класифікацію огляду особи та її речей як превентивного заходу за допомогою визначених критеріїв. Вказується на доцільності проведення роботи на законодавчому рівні щодо розподілу огляду на види, уніфікації термінології, здійснені його класифікації та детальному визначенні підстав і порядку застосування кожного виду огляду в єдиному законодавчому акті. The article is devoted to the disclosure of the phenomenon of the person`s inspection and his belongings as an administrative and preventive measures in the activities of law enforcement agencies of Ukraine and highlighting its main types. The article examines the national legislation and the works of the scientists regarding the grounds and procedure for inspecting a person, personal belongings, hand luggage, and luggage by officials of customs authorities, Penitentiary Department, State Border Guard, the National Police, Aviation Security Service, and the like. It is noted that the procedure for inspection of a person and his belongings in the current legislation is regulated only in general terms, this also applies to the secondary legislation, that is a weakness of domestic legislation and in practice leads to an ambiguous interpretation by law enforcement officials and the unjustified application of these coercive measures to citizens or vice versa, due to the excessive complication of verification procedures ˗ to evading the performance of their official duties. The current legislation defines inspection as an investigative action in the investigation of criminal cases; measures to ensure the proceedings in cases of administrative offenses; form of customs control; preventive action by the police, control procedure for security; preventive measures. The author proposes his own classification of the person`s inspection and his belongings as a preventive measure by certain criteria. It is indicated the expediency of carrying out work on the distribution of inspection into types, unification of terminology, its classification and a detailed definition of the grounds and procedure for the application of each type of inspection in a single legislative act.
