Правові аспекти забезпечення міжнародної конкуренції авіаперевізникам України

Abstract

В статті порушується проблематика правового забезпечення авіаперевізників України в умовах міжнародної конкуренції та визначено основні правові аспекти успішної конкурентоспроможності на ринку авіаційних перевезень. The article deals with the issues of legal guidance of air carriers in Ukraine under conditions of international competition on both internal and foreign flight markets. Despite the fact that this problem has been addressed to in a number of scientific works, there has not been made any integral research in legal literature yet. The aim of the article is to analyse the state of international competition, determine the main legal trends to ensure healthy competition and reveal the aspects of legal guidance of air carriers in Ukraine under conditions of international competition. It is stated that working out and legal basis of an efficient strategy will ensure proper competition and protect national interests on international markets. To achieve the stated aim it is necessary to undertake a profound analysis of the state of international competition and later apply its results in legal guidance of air carriers. The basic legal aspects of successful competitiveness on the air carrier market are the antimonopoly and competition policy regulation, working out mechanisms of implementation of competition policy and securing it in national legislation by adopting new law and normative acts and bringing the existing ones into line with the international legal standards, unity of standards and norms of passenger attendance. An important legal precondition for ensuring healthy competition of air carriers must be a clear unified regulatory mechanism of permit for air carriers to work on certain airlines while Ukrainian airports must pursue efficient marketing policy.
