Abstract: У статті розглянуто вимоги щодо учасників процедури публічних закупівель, проаналізовано перелік та зміст критеріїв постачальника публічних закупівель відповідно до вимог Директиви ЄС. Обґрунтовано застосування інших, ніж цінові пропозиції, підходів до оцінки постачальників закупівель. Запропоновано проводити господарсько-правову ідентифікацію постачальників закупівель на основі оцінки дотримання принципів закупівель відповідно до їх законодавчого регламентування: заборона дискримінації, рівноправне звернення, прозорість, конфіденційність. Abstract Introduction. The large volumes of public procurement and the scale of participants in procurement procedures determine the importance of public procurement. The electronic procurement system introduction in Ukraine has made it possible automating the information field of tender procedures and at the same time receiving the direct information about the significance of these processes. The above mentioned necessitated the adaptation of legal tools to determine the role and responsibilities of customers, suppliers, who make purchases. The issue of the procurement participants’ identification features the high corruption risks in this area and the need to maintain competition during the procurement procedures. At the same time, the unprofessional actions of the procurement customer take place aiming at monopolizing the areas of activity, giving illegal priority to certain enterprises, which indicates the corrupt actions of the customer’s representatives. Therefore, the relevance of research on the public procurement participants’ identification in the regulatory field has determined the nature of this article. Purpose. The study is devoted to the development of commercial and legal identification of the public procurement participants and its practical implementation in the electronic procurement system. Results. The procurement procedures conditions are analyzed, taking into account their electronic environment. It is established that the domestic legislation on public procurement takes into account the provisions of EU Directives in this field. As determined, the customer should form the selection criteria for economic entities in the selection process, put forward the general requirements for the supplier, and determine the selecting strategy for the supplier, who is the tender winner. The assessment requirements for the supplier in the procurement process on the basis of the criteria defined by the EU Directive are summarized: selection criteria, general requirements, the economic condition indicators, technical and qualification characteristics, assessment of advantages and disadvantages. Two approaches to the criterion assessment are suggested, which establish the commercial and legal basis for determining the procurement winner: the criterion of the minimum price or the criterion of the most advantageous offer, taking into account the qualitative characteristics and additional supply conditions of the procurement. It is suggested performing the evaluation process of tender applications to identify the suppliers, taking into account the approach of key principles of public procurement: non- discrimination, equal treatment, transparency, and confidentiality. Originality. The development of legal requirements in the new reality of e-procurement requires simpler rules and broader tools for the commercial and legal identification of procurement participants. Conclusion. Changing the environment of public procurement in Ukraine into the automated system requires development of new approaches to the commercial and legal identification of its participants. Customers, authorized to announce procurement procedures, are invited to identify suppliers taking into account the implemented European standards.
