Становлення спільної транспортної політики ЄС у сфері повітряних перевезень: управлінсько-правовий вимір

Abstract

Метою цієї статті є проведення комплексного дослідження становлення спільного транспортного простору Євросоюзу на основі ухвалених нормативно-правових актів та прийнятих глобально-управлінських рішень, що регулюють ці відносини, а також у контексті розвитку публічної політики щодо забезпечення функціонування авіаційного транспорту України. Дослідження становлення спільного транспортного простору Євросоюзу здійснено шляхом побудови періодизації розвитку нормативно-правової бази, прийнятих глобально-управлінських рішень у сфері повітряних перевезень ЄС за часовою протяжністю. Автор виокремлює такі періоди становлення: перший період (1950–1970-ті роки) характеризується початком розвитку інтеграційних процесів у транспортній сфері Західної Європи; другий період (80-і роки минулого століття) визначено як етап активного розвитку правової бази та лібералізації повітряного транспорту Європи; третій етап (90-і роки минулого століття) характеризується як період створення транспортної мережі; четвертий період (з 2000 року і дотепер) – це період стрімкого розвитку спільної транспортної політики ЄС. У статті описана участь України у процесі євроінтеграції. Цей процес відбувається на основі договірних відносин з Євросоюзом, що передбачає поступову реалізацію на території України спільних правил міжнародних перевезень, зміцнення європейської безпеки та екологічних стандартів. Також запропоновані напрями відновлення транспортної інфраструктури України у межах Плану післявоєнного відновлення авіапослуг у повітряному просторі України. The purpose of this article is to conduct a comprehensive study of the formation of the common transport space of the European Union on the basis of adopted legal acts and adopted global management decisions regulating these relations, as well as in the context of the development of public policy to ensure the functioning of air transport of Ukraine. The study of the formation of the common transport space of the European Union was carried out by constructing a periodization of the development of the regulatory and legal framework, adopted global management decisions in the field of EU air transportation over time. The author singles out the following periods of formation: the first period (1950–1970s) is characterized by the beginning of the development of integration processes in the transport sphere of Western Europe; the second period (80s of the last century) is defined as the stage of active development of the legal framework and liberalization of air transport in Europe; the third stage (90s of the last century) is characterized as the period of creation of the transport network; the fourth period (from 2000 to the present) is a period of rapid development of the common transport policy of the EU. The article describes the participation of Ukraine in the process of European integration. This process takes place on the basis of contractual relations with the European Union, which provides for the gradual implementation on the territory of Ukraine of common rules of international transportation, strengthening of European security and environmental standards. Directions for the restoration of the transport infrastructure of Ukraine within the framework of the Plan for the post-war restoration of air services in the airspace of Ukraine are also proposed.
