Виклики та загрози дитинства у сучасному суспільстві (правовий аналіз)

Abstract

У статті проводиться аналіз правового статусу дітей. Констатовано, що правове регулювання питання статусу дітей пройшло довгий період становлення. Він включає три етапи: рекомендаційний характер норм (Декларація прав дитини), громадську активність Міжнародний рух щодо захисту прав дітей(70-ті роки ХХ ст.); прийняття між-народних стандартів у сфері дитинства (Конвенція ООН про права дитини). Проте сучасне суспільство має доволі широку кількість не-врегульованих правових проблем, до яких нині має бути прикута особлива увага. Зосереджено на згрупуванні тих викликів та загроз, які існують у сучасному суспільстві, що глобалізується щодо становища дитини. В статье проводится анализ правового статуса детей. Констатировано, что правовое регулирование вопроса статуса детей прошло долгий период становления. Он включает три этапа: рекомендательный характер норм (Декларация прав ребенка), общественную активность Международное движение по защите прав детей (70-е годы ХХ в.) принятие международных стандартов в сфере детства (Конвенция ООН о правах ребенка). Однако современное общество имеет довольно широкое количество неурегулированных правовых проблем, к которым сейчас должно быть приковано особое внимание. Сосредоточено на группировании тех вызовов и угроз, которые существуют в современном обществе, глобализирующемся о положении ребенка. The article analyzes the legal status of children. It was stated that the legal regulation of the status of children has undergone a long period of formation. It includes three stages: the advisory nature of the norms (Declaration of the Rights of the Child), public activity, the International Movement for the Protection of the Rights of the Child (70s of the 20th Century); adoption of international standards in the field of childhood (UN Convention on the Rights of the Child). However, modern society has quite a large number of unsettled legal problems, which special attention should be given today. Within this research, the focus is on grouping of the challenges and threats that exist in a modern society that is globalizing towards the child’s situation. 1. The problems of child protection during an armed conflict remain pressing. The development of technical progress has led to an update of the means of conduct of hostilities, as well as conflicts have expanded considerably so the problem remains urgent. 2. Threats to children being sexually exploited. 3. The problem of lack of access to education, or an inadequate quality of the educational process. The right to education for children is one of the main. Education offers children a way to overcome poverty and a path to a long-term future. 4. The problems in the sphere of child labor. Millions of children around the world are suffering from child labor exploitation, depriving them of their childhood, health and education. 5. Domestic violence and child protection. Children in various ways become victims of domestic violence. Many children who are victims of violence are direct victims of physical violence. Children who witness domestic violence or are themselves victims of violence are at a serious risk of long-term physical and mental problems. Children may not be subjected to physical violence themselves, but they are also victims, as they witness violence between their parents, may also be prone to sublimation of such relationships in the future. 6.
